Body Confidence Program & Group Training Specific Terms & Conditions
– You participate at your own risk, you must obtain a clear health assessment from your doctor or GP prior to exercise.
– Sessions are to be booked online.
– All sessions must give 24hrs notice prior to cancellation otherwise the session still counts towards the members 3x advance weekly bookings. Bookings from here on must be made on the day.
– If you are late for your session, we must still finish at the same time in order to not affect members in the next time slot.
-If you are late it is your responsibility to warm up thoroughly before joining the session in progress.
– If your health changes or deteriorates in any way, you must tell us prior to your session.
– A PARQ must be filled out prior to training. Otherwise training cannot go ahead.

– Photographs may be taken during sessions for use on social media pages. You have the right for these images not to be used.
– Training may be carried out by any instructor of AK Active.
– Rolling memberships can be frozen for a maximum of one month only. After one month the membership becomes invalid and will cease.
– We cannot pause memberships for a week due to illness. The member is debited for a set period in advance which they have agreed to.
– No refunds of programs or deposits are permitted following opt in to a program, the member is able to postpone and join one at a later date however this must be within three months of purchase.
– The sessions are run at set times. Please attend every session that you signed up for in order to get the best out of the program.
– We cannot place extra sessions on for those who have missed them.
– We cannot add extra people into a session if that session is full, should they miss their original slot as the group is strictly limited. We also cannot add more sessions on if you miss out on a session. The sessions are 3x per week at set times unless otherwise communicated by the AK Active team.
– Free products are subject to availability.
– The plan WILL work providing that you stick to it. Changes are dependant upon your consistency and devotion to the plan.
– If the member wants to opt out before starting and after having paid the full price. They will be deducted the set up costs and the cost of nutrition plan if it has already been supplied. This is 10% of the program plus £30 nutrition plan creation.
– Non-contract memberships run as a direct debit and must be cancelled 7 days prior to the next charge date. If fewer than 7 days remain, the next month payment will be taken. The client can cancel by emailing contact@akactive.com. It is the responsibility of the client to cancel their membership by informing us should they wish to do so. Membership cannot be frozen or paused.
12 Month Annual Subscription Terms & Conditions
– All annual memberships are for a term of 12 months. After 12 months, the membership will become rolling and can be cancelled with one months notice.
– The Direct Debit Payment Amount is due from you to us with the first one being paid on the 1st Direct Debit Payment Date and then every month thereafter for a period of 12 months. You are obligated to make every Direct Debit Payment regardless of non-attendance.
–Â You agree to advise us promptly of any change to the Members Details provided.
– If you fail to pay any amount due under this agreement for a period of more than thirty days, then we may pass the debt to a third party company for collection. The reasonable and direct costs incurred in employing the third party company will be borne by you including costs in tracing you if you have changed your address without telling us.
– If you choose to pay your Annual membership fee over the 12 month period the payments from you will be collected by 12 equal monthly direct debits on or around the 1st working day of each calendar month. You will pay more under a monthly payment plan compared to a full payment in advance plan.
– Please allow up to 14 days for any refunds to be processed.
Cancellation of 12 month contracts
– Relocation:Â This agreement can be cancelled in the event that your new permanent address is more than 15 miles away from the facility upon receipt of a copy utility bill or bank statement showing the new address.
– Long term (over 3 month) illness or injury:Â This agreement may be cancelled in the event of an illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided.
– Redundancy:Â This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.
– Pregnancy: This agreement can be cancelled if you become pregnant upon the appropriate written proof being given. Please note – ANY Cancellation for the above reasons will not be effected until the appropriate proof is provided and received (in writing or via email.)
– If you wish to freeze your membership you can do so by providing AK Active with, one full calendar months notice in writing. It is you responsibility to get proof of this.
– A freeze period does not affect the Minimum number. of Direct Debit Payments you are due to make and any payments remaining at the time of the freeze will remain due and recommence on a monthly basis once the freeze period has completed.
– Memberships cannot be frozen due to holidays
– The agreement may be frozen in the event of a temporary illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period of time.
– We may terminate this agreement with immediate effect on notice to you if you are in breach of the Clubs Rules (i.e. Stealing or other criminal activities within the facility). In this event you will not be liable to pay any further Direct Debit Payments, provided such breach is not deemed by us to have occurred primarily in order to qualify you for a refund.
Nutrition Plans
– Nutrition plans are not refundable.
– The client is able to postpone the plan should any issues arise . The client can then resume the plan when ready. NOTE: this applies within 2 weeks only.
– The plan WILL work providing that you stick to it. Changes are dependant upon your consistency and devotion to the plan.
– Nutrition plans are provided on a 1 week turnaround from time of submission of the nutrition plan questionnaire.
– If the member continues to make progress on the nutrition plan, no changes need to be made. There is plenty of choice within the plan. It is about consistency. This is what will get results.
– Check ins must be on a Thursday before midday without exception. Please remember to check in to avoid missing out on any necessary diet changes.
– Nutrition plans are to be used as a guide only.
Training Plans
– Ensure that you are thoroughly warmed up before training and following the plan.
– Team AK accept no responsibility for any injuries that occur when training. Ensure good form throughout.
– Remember to cool down post workout to allow heart rate to return to normal.
– You participate at your own risk, you must obtain a clear health assessment from your doctor or GP prior to exercise.
Supplements
– Once the protective seal is broken, supplements become non-refundable. This is applicable unless in exceptional circumstances where there may be something wrong with the supplements themselves however this is highly unlikely.
– Supplements are not a replacement for a healthy diet. They are designed to help alongside your plan and will not achieve results alone.
– Do not take if you have heart problems, are pregnant or are breast feeding.
– Please consult with your GP before taking any type of supplement.
– Read the label before taking any supplementation.
Activities outside of the AK Active studio.
AK Active may hold events outside of the usual timetabled sessions.
– The participant is responsible for their own safety and wellbeing during any such event.
Personal Training Sessions
– Please ensure that you are warmed up before you start the session so that it does not eat into your training time. We can perform a warm up together but bear in mind, this will take up some of the training time.
– All sessions must be paid for in advance without exception.
– Pre-paid personal training sessions must be taken within 3 months of purchase. This applies for block purchases. Otherwise the sessions will be lost.
– Personal training sessions must be cancelled no later than 24 hours prior to the session starting otherwise they will still be charged in full.
Other Information
Participant acknowledges that there are risks involved in participating in any exercise and wellness program and understands that the Company recommends that the Participant obtain authorisation from his/her medical provider prior to beginning the Company’s exercise and wellness program. In this connection, the Company’s exercise and wellness program shall include, but not be limited to, intense weight training, strenuous aerobic activity, and nutritional counselling.
Participant agrees, today and on all future dates, (1) that he/she is voluntarily participating in the Company’s exercise and wellness program and assumes all risk of injury (including, but not limited to, death, paralysis, heart attack, and injury to bones, joints, or muscles), the contraction of any illness or medical condition that might result, or any damage, loss, or theft of any personal property, and (2) that the use of all facilities the Company owns, leases, or otherwise uses, shall be at the sole risk of the Participant and/or the Participant’s guest.
Accordingly, the Company shall not be liable in any fashion for any injury to the Participant and/or the Participant’s guest or any damage to the personal property of the Participant and/or the Participant’s guest and the Company shall not be subject to any claim, demand, injury, or damages whatsoever, including, without limitation, those demands resulting from any acts of negligence on the part of the Company, its officers, owners, agents, employees, independent contractors, or others.
In consideration of his/her participation in the Company’s exercise and wellness program, the Participant for himself/herself and on behalf of his/her executors, administrators, successors, and assigns, does hereby expressly forever release and discharge the Company, its successors and assigns, as well as its officers, owners, agents, employees, independent contractors, or others from all claims, demands, injuries, damages, or causes of action arising out of or in connection with the Company’s negligence.
This Agreement includes, without limitation, injuries that may occur as a result of (1) the Participant’s use of any exercise equipment, (2) the Company’s improper maintenance of any exercise equipment, and/or (3) the Company’s negligent instruction, counselling, or supervision in connection with the exercise and wellness program. The Participant further agrees to save, indemnify, and hold harmless the Company, its officers, owners, agents, employees, independent contractors, or others from all costs and expenses, including its reasonable attorneys’ fees, arising from claims and demands which are the subject matter of this Agreement.
Participant is aware that the Company does not provide any kind of insurance for his/her benefit in connection with the Company’s exercise and wellness program. Participant understands that this Agreement is intended to be as broad and inclusive as permitted by the law and agrees that if any portion is held invalid, the remainder of the Agreement will continue in full legal force and effect.
By beginning an AK Active plan you agree to take part and acknowledge and agree to the above T&C’s.
GDPR – How we use your information
– We will never share your personal information.
– Your personal information submitted as either PAR-Q or nutrition questionnaire is used solely to develop your tailored plan.
– Images and results may be used for promotion however you have the opportunity to object to this.
– Your email address will NEVER be passed on.
